Retail giant Marks and Spencer plc have been convicted of putting members of the public, staff and construction works at risk of exposure to asbestos contaminated materials during the refurbishment of two of its stores.
The Health and Safety Executive (HSE) prosecuted Marks and Spencer plc, Willmott Dixon Construction Ltd and PA Realisations Ltd (formerly Pectel Ltd) for the work carried out between 2006 and 2007 on their retails stores in both Reading and Bournemouth.
According to a press articles released by the HSE on 18th July 2011, during the case heard at Winchester Crown Court, the prosecution revealed that Marks and Spencer plc did not allocate time and space for the removal on the asbestos-containing materials at one of the stores and contractors were forces to work in enclosed spaces around the contaminated materials.
In addition the contractor, PA Realisations Ltd, “failed to reduce to a minimum the spread of asbestos to the Reading shop floor”. “Witnesses said that areas cleaned by the company were re-contaminated by air moving through the void between the ceiling tiles and the floor above, and by poor standards of work.”
The guilty companies will be sentenced on 26 September 2011.
